Cases Highlight Risk of FMLA Estoppel Claims By Employees

Brian D. Carlson and Soyoung Yoon co-authored a special feature, “Cases Highlight Risk of FMLA Estoppel Claims By Employees,” for the November 2015 issue of New England In-House. In the article, Brian and Soyoung discuss the potential hazards employers face if they erroneously inform employees that they are eligible to take leave under the federal Family and Medical Leave Act (FMLA). The authors examine a recent case in this area and also convey recommendations designed to help employers ensure that their policies and practices are consistent with all FMLA leave criteria.
