Practical Tips and Strategies For Complying With The MA Data Security Law and Regulations

The deadline for compliance with the Massachusetts Data Security regulations was March 1, 2010, but not all employers are in compliance.

The goal of this training is to give you a general understanding of the law and important tools to assist you in your compliance efforts.  The training covers the following important topics:

 

  • An overview of the Massachusetts Data Security statute regarding record retention/disposal and breach;
  • An overview of the key regulatory requirements for safeguarding personal information;
  • Conducting a preliminary audit and addressing the information gathered in the audit;
  • Updating and implementing personnel policies and employment agreements;
  • How to develop a Comprehensive Written Information Security Program (“WISP”);
  • Third-party vendor and service provider compliance issues; and
  • Mandatory employee training.

Dual Use Devices In The Workplace: Understanding and Managing The Risks

Employers that permit employees to use personal mobile devices (i.e., iPhones, iPads, Android smartphones, personal laptops, etc.) to create and/or access work-related data cannot rely upon existing electronic communication and conduct policies to provide adequate protection against the significant risks created by the blending of personal and work activities. The Bring Your Own Device (“BYOD”) trend is forcing employers to re-evaluate everything from compliance with data security laws, and trade secret protection, to wage and hour issues. In addition, dual use devices create significant challenges to existing workplace conduct policies. Given the ever-increasing number of dual use devices already being used in many workplaces, employers have no choice but to develop a comprehensive plan for addressing these new challenges.

This interactive presentation, held at the Devens Common Center, will focus on best practices for BYOD policies, procedures and agreements related to students.  Sara Goldsmith Schwartz will discuss solutions to practical and legal difficulties that arise when students use their own devices on and off campus and/or to access the school’s network.  Sara will use sexting and cyber-bullying case studies to address issues that often arise in the BYOD context.  Attendees will receive useful checklists to help establish sound BYOD policies and procedures for students.
