Todd A. Newman is a Partner at Schwartz Hannum PC. Todd concentrates his practice on labor and employment litigation, counseling and training. He also is editor-in-chief of the Firm’s Legal Updates.
In the area of traditional labor, Todd has significant experience under the National Labor Relations Act, the Railway Labor Act and the Federal Service Labor-Management Relations Statute. Todd has successfully represented labor clients before the National Labor Relations Board, the National Mediation Board, the Surface Transportation Board, and other federal agencies. He has negotiated collective bargaining agreements and represented management in numerous labor arbitrations, amassing a strong record of success in enforcing management’s rights. Todd also trains and assists employers in the area of union avoidance. His significant labor experience covers healthcare, transportation and other industries.
As Attorney-Advisor to the Chair of the Federal Labor Relations Authority in Washington, D.C., Todd received the “Hammer Award” from Vice President Gore for his role in revising the agency’s unfair labor practice regulations. Similarly, Todd’s article A Suggested Approach to Applying the National Mediation Board’s Railroad Merger Procedures, 15 The Labor Lawyer 483 (American Bar Association 2000), is a leading article in this complex area of labor law.
As a litigator, Todd has championed his clients’ interests in numerous state and federal courts throughout the country, including in California, Connecticut, the District of Columbia, Maryland, Massachusetts, Michigan, Mississippi, Pennsylvania and Virginia. Todd also has successfully represented clients before the Massachusetts Commission Against Discrimination, in various other quasi-judicial proceedings, and in arbitrations under the auspices of such groups as the National Association of Securities Dealers (“NASD”).
Todd’s cases have involved cutting-edge issues in such areas of the law as partnership, fiduciary duty, trade secrets, enforcement of noncompetition agreements, classification of workers as employees and independent contractors, payment of wages and employment discrimination. Todd also has significant experience in defending class-action lawsuits.
Todd’s reported decisions include Belveron Partners Fund I, LP v. Augustus Manor Associates Limited Partnership, 2010 WL 1665249 (Conn. Super. Ct. 2010); Jackson v. McKesson Health Solutions LLC, 10 WH Cases 2d 374 (D. Mass. 2004); Nicolaci v. Anapol, 387 F.3d 21 (1st Cir. 2004); Prozinski v. Northeast Real Estate Services, LLC, 59 Mass. App. 599 (2003); In re Mortgagors of Temple-Inland Mortgage Corporation, 2001 WL 177181 (E.D. Pa. 2001); and Superior Bank, F.S.B. v. Tandem National Mortgage, Inc., 197 F. Supp. 298 (D. Md. 2000).
Prior to entering the legal profession, Todd provided public-relations, marketing-communications and crisis-communications services to independent schools and colleges throughout the country.
